Successful Representation of a Fuel Wholesaler in a Civil Case Concerning Reimbursement of an Allegedly Erroneous Payment

Roberts Rimša, a member of the Ellex Litigation team in Latvia, has successfully represented a fuel wholesaler as a defendant in a civil case where a claimant (former business partner of the defendant) tried to recover an amount of related-party debt voluntarily paid by the claimant (based on an oral agreement), while later on (in the court) the latter dishonestly claimed that the payment was made by mistake.

Although there was no written agreement or any other undertaking for the claimant to pay the related-party debt (guarantee, surety, etc.) or confirming the fact that the claimant had paid the related-party debt voluntarily, the court has resolved the dispute in favour of Ellex’ client. The claimant has not appealed the court judgment.
