Court of Justice of the European Union recognizes a government regulation as non-compliant with the Directive 2014/24/EU

Ellex in Latvia helped to achieve a positive decision in the EU Court case C‑769/21 regarding the request for a preliminary ruling in accordance with the Article 267 of the TFEU, submitted by the Administrative District Court in the administrative proceedings regarding the application of the applicant AAS “BTA Baltic Insurance Company” against the Procurement Supervision Office and the Ministry of Justice.

Part of the Cabinet of Ministers’ regulation No. 107 “Procedure of procurement procedures and design tenders” has been recognized by the CJEU as non-compliant with the Directive 2014/24/EU.

Following the judgment of the Court of Justice of the European Union, legal proceedings in the Administrative District Court will resume.

Update 13.04.2023: the client AAS “BTA Baltic Insurance Company” with a help of our office has achieved a successful result, the Procurement Monitoring Bureau and the Ministry of Justice has not appealed the judgement of the Administrative district court, and the judgement has entered into force.
